DISTRICT COURT

NEWBURYPORT: The following cases were recorded Friday, Nov. 20, in Newburyport District Court. Judge Peter Doyle presided over the following jury-waived trials:

James P. Frederick, 35, 352 Island Point Road, Derry, N.H.; driving without a license, guilty, dismissed upon payment of $200 fine and $50 Victim Witness Fund (VWF) (West Newbury).

Totianna Brown, 17, 101 Pleasant Valley Road, Amesbury; two counts of assault and battery, continued without a finding for one year, attend anger management classes, stay away from victim (Amesbury); assault and battery, continued without a finding for one year; disorderly conduct, continued without a finding for one year (Amesbury).

Charles F. Gabriel, 39, 344 Pinehill Road, Berwick, Maine; driving while under the influence of alcohol, guilty, two years' probation, entry into Alcohol Safety Awareness Program, 90-day loss of license, restitution to be determined, $250 Head Injury Assessment, $250 OUI Fee, $50 OUI Victims Assessment, $50 VWF; reckless driving, dismissed (Salisbury).

John W. Whelan, 39, 15 Woodward Ave., Seekonk; negligent driving, continued without a finding for six months, $250 Head Injury Assessment, $50 VWF; marked lanes violation, not responsible; failure to signal, not responsible; speeding in a special regulation zone, responsible, $300 fine (Newbury).

Michael F. Harrington, 38, 213 Franklin St., Haverhill; possession of class E drugs, continued without a finding for six months; driving with a suspended registration, continued for six months, $100 in court costs; driving uninsured, continued for six months, $200 in court costs, $50 VWF; open container of alcohol in vehicle while driving, responsible, $250 fine (Rowley).

Brian E. Beaudry, 41, 2 Broad St., Newburyport; driving while under the influence of alcohol (second offense), guilty, three years' probation, entry into ASAP, half day Brains At Risk Program, 90-day loss of license, $250 Head Injury Assessment, $250 OUI Fee, $50 OUI Victims Fee, $50 VWF; failure to yield at an intersection, not responsible, marked lanes violation, responsible, filed (Newburyport).

Nicholas A. Metcalf, 29, 53 Brown Ave., Amesbury; assault and battery, guilty, probation for two years, stay away from victim, sex offender evaluation and any treatment deemed necessary, $50 VWF; assault and battery, dismissed; indecent assault and battery on a person over 14 years old, pretrial probation for two years, if evaluation determines no treatment is necessary, case may be dismissed at that time; assault and battery on a person over 14 years old, dismissed; accosting or annoying a person of the opposite sex, dismissed; accosting or annoying a person of the opposite sex, dismissed (Amesbury).

Lynne E. Crosby-Montecalvo, 47, 19 North Atkinson St., Newbuyport; driving while under the influence of alcohol (second offense), guilty, six months in the house of correction, sentence suspended two years, 14-day inpatient treatment and follow-up, two-year loss of license; child endangerment by OUI, guilty, placed on pretrial probation for two years (Rowley).

Rose N. Melvin, 26, 11 Railroad Ave., Salisbury; assault and battery, dismissed upon failure to prosecute; witness intimidation, dismissed upon failure to prosecute (Salisbury).
